Store Terms
1. Validity of Sales Terms.
1.1. The terms of sale apply to the relationship between the buyer (hereinafter referred to as “buyer”) and the seller, IVM Agency OÜ (hereinafter referred to as “seller”), when purchasing goods and services in the online store mytyre.ee (hereinafter referred to as “online store”).
1.2. In addition to these terms, the legal relationships arising from the purchase of goods in the online store are governed by the Law of Obligations Act, the Consumer Protection Act, and other legal acts in force in the Republic of Estonia.
1.3. The seller reserves the right to amend the terms of sale. Any changes will be published on the website of the online store.
2. Selecting Products and Placing Orders in the Online Store.
2.1. The buyer can place an order in the online store without registration. It is sufficient to fill in all the required fields of the order form. The buyer’s shopping cart is created after clicking the “Add to Cart” button.
2.2. After confirming the order submission by clicking the “Place Order” button, the buyer is directed to a page to select the delivery and payment method. After choosing a suitable delivery and payment method, the buyer’s data is entered. Optionally, the buyer can also register as a regular customer /this allows viewing purchase history, accumulating and using bonuses, etc./
2.3. After selecting the delivery and payment methods and clicking the “Pay” button, follow the payment center instructions. Ensure that you have entered the correct information, as errors may result in delayed or failed delivery of the order.
2.4. Once the delivery method and address have been specified and the order has been paid, the buyer can view the service invoice in the “Order History” section. A copy of the invoice is automatically sent to the email address provided in the order.
2.5. The purchase agreement is deemed concluded (entered into force) from the moment the order payment is received in the bank account of IVM Agency OÜ.
2.6. Please be attentive when filling out the data fields. The buyer is responsible for the accuracy of all fields in the order form. If there are errors or incomplete information in the “Name,” “Delivery Address,” or “Contact Phone” fields, the seller is not liable for the timely fulfillment of the order.
3. Payment.
3.1. All prices displayed in the online store are in euros and include the applicable VAT of 20%.
3.2. The cost of transportation is added to the price of the purchased product according to the selected delivery method /to a parcel machine, post office, by courier, or the buyer collects the product themselves – in this case, no delivery fee applies/.
3.3. After the buyer adds the order to the shopping cart, the delivery cost is added to the price of the items in the cart. The delivery cost will also be reflected in the invoice.
3.4. The delivery cost is calculated automatically provided that one order is delivered to one address. If the buyer wants the products delivered to different addresses, separate orders must be placed.
3.5. Payment methods:
– via online bank;
– by credit card;
– via PayPal;
3.6. After completing the payment, the online store will send you an order confirmation and invoice.
3.7. All personal data received by the seller during the buyer’s visit to the online store and purchase transactions are treated as confidential. The encrypted data exchange channel with each online bank ensures the security of the buyer’s personal information and bank details. The seller’s representatives do not have access to such encrypted personal data of the buyer.
4. Delivery of Goods.
4.1. After the contract enters into force as per section 2.5, the goods received in the seller’s warehouse are delivered to the buyer using the delivery method specified during the order process. The standard delivery time is 1-3 business days.
4.2. The delivery times indicated on the online store’s website begin from the moment the payment for the order is received in the seller’s bank account. To ensure timely delivery, the delivery information provided during the order process must be accurate and up-to-date.
4.3. The seller is not responsible for delays in the delivery of goods if the goods were handed over to the logistics partner on time but the delay occurred due to circumstances beyond the seller’s control or foresight.
4.4. If timely delivery of goods is not possible due to reasons beyond the seller’s control, the buyer will be notified of the delay via the contact phone number or email provided in the order, and a new delivery date for the ordered goods will be specified.
4.5. The seller is not obligated to compensate the buyer or third parties for any potential damages related to delayed delivery of goods.
4.6. The goods are handed over to the buyer based on accompanying documents. Before accepting the goods and confirming receipt with a signature on the accompanying documents, it is recommended to inspect the goods. If visible damages are found, it is advised not to accept the goods.
5. Order Cancellation and Goods Return.
5.1. The buyer has the right to withdraw from the contract without giving a reason within 14 days. Upon returning the product (withdrawing from the contract), IVM Agency OÜ will refund all payments received from the consumer under the sales agreement, including delivery costs (except for additional costs resulting from the buyer’s choice of a delivery method other than the cheapest delivery option offered by IVM Agency OÜ) no later than 14 days.
5.2. When withdrawing from the sales contract, the buyer must return the goods to the seller /or exchange them/ in the original intact factory packaging, completing the goods return/exchange form “Return Form.” The spare part’s packaging is part of the product and ensures its safety and identification. If maintaining the integrity of the factory packaging is not possible when inspecting the product, it should be opened as carefully as possible with minimal damage to the product’s appearance.
5.3. When returning or exchanging goods, adhesive tape /or other adhesive substances/ or stickers must not be applied, nor should anything be written directly on the factory packaging. The product box and its internal components must be placed in a separate cardboard or plastic container.
5.4. In the case of product exchange, the seller bears the shipping costs of the product to the buyer. The buyer must specify visible differences between the purchased and installed product on the car /such as dimensions, location and type of fittings, distances between them, and provide drawings or photos if possible, sending them to the email address info@mytyre.ee/.
5.5. If the returned product’s condition has deteriorated, the buyer is responsible for the decrease in value caused by using the product in a manner not necessary to ascertain the nature, characteristics, and functioning of the item. To determine the nature, characteristics, and functioning of the item, the product may only be used as it is usually allowed in a store.
5.6. The seller covers the cost of returning goods if the goods were damaged during transport, if defects could not be identified by visual inspection, or if the goods or their quantity do not match the order.
5.7. The seller may cancel the order in the following cases:
– the buyer did not make a prepayment for the invoice issued based on the order within the time specified in the invoice;
– the ordered goods are out of stock at the supplier, and the buyer does not agree to the replacement product offered by the seller /similar in quality or close in parameters/;
– the delivery time of the goods is significantly extended due to reasons beyond the seller’s control, and the buyer does not agree to a longer wait for the order;
– the order cancellation occurs either through phone communication and/or correspondence with the seller’s mandatory written confirmation stating the reasons for the inability to fulfill the contract.
5.8. In case of the seller’s refusal to fulfill the contract, the prepayment is refunded to the buyer’s bank account within 7 business days of receiving the corresponding notification.
5.9. The goods can be returned:
– directly to the Mytyre store at Pae 21;
– via Mobeston courier to Pae 21;
– via Omniva or DPD parcel machines at Paepargi Maxima XX.
6. Principles of Data Protection and Processing.
6.1. The seller uses the buyer’s personal data solely for the purpose of fulfilling the order. The seller does not disclose the buyer’s personal data provided for order processing to third parties, except in cases stipulated by law. Communication between the bank and the buyer is protected by an SSL protocol (encrypted data transmission channel), ensuring that third parties cannot access or alter the transmitted information. The information between the bank and the seller is protected by digital signatures.
6.2. By registering as a regular customer, the buyer automatically gives the seller permission to notify them by email about discounts, promotions, and special offers.
6.3. The buyer has the right to unsubscribe from newsletters and remove their information from the customer database.
7. Responsibility and Dispute Resolution
7.1. In the event of a breach of the terms of the general conditions /contract/, the responsibility of the seller towards the buyer or the buyer towards the seller is regulated according to the legislation of the Republic of Estonia.
7.2. If the buyer disagrees with the decision proposed by the seller and believes that their rights have been violated or their interests have been harmed, the buyer can file a complaint with the consumer complaints commission through the Consumer Protection Department or go to court. The consumer may submit the complaint personally or through a representative. The contact details of the consumer protection commission are available on the website of the Consumer Protection Department. For resolving issues that arise in the European Union member states, one should contact the European Consumer Centre Consultation Center.
7.3. In any case, IVM Agency OÜ’s responsibility is limited to compensation for direct material damage, and Mobeston autovaruosad.ee OÜ is not liable for non-material damages or lost profits. The compensation paid by IVM Agency OÜ can never exceed the amount paid for the product.
7.4. When considering cases of product defects, the Buyer and IVM Agency OÜ follow the principles of submitting claims, which are an integral part of the sales transaction and which the Buyer can review on the homepage of IVM Agency OÜ.

8. Other Conditions.
8.1. Conditions for returning cores. The price of certain products such as EGR valves, brake calipers, starters, alternators, power steering pumps, and steering racks usually includes a deposit according to the amount set by the manufacturer. The deposit is refunded after the return of the old core and the expert confirmation that the core is intact. The money is refunded within 30 days from the return of the old core.
8.2. Brake calipers. The old brake caliper core should be returned clean and in its original packaging. The returned core must be repairable and complete. The core must not show signs of welding, wear, or mechanical damage. All edges and mounts must be intact and functional. The technical specifications of the returned product must be equivalent to the technical specifications of the purchased product.
8.3. EGR valves. The old core should be returned clean and in its original packaging. The returned core must be repairable and complete. The technical specifications of the returned product must be equivalent to the technical specifications of the purchased product.
8.4. Alternators, starters, and climate compressors. The old core should be returned clean and in its original packaging. The returned core must be repairable and complete. The core must not show signs of oxidation, welding, wear, or mechanical damage, meaning all edges and mounts must be intact and functional. The rotor shaft end of the starter should not show signs of overheating (blue color), and the bearings should be intact and functional. The technical specifications of the returned product must be equivalent to the technical specifications of the purchased product.
8.5. Steering racks and pumps. The old core should be returned clean and in its original packaging. The returned core must be repairable and complete. The core must not show signs of oxidation, welding, wear, or mechanical damage, meaning all edges and mounts must be intact and functional. The rack teeth of the steering rack must not show signs of damage or rust. The technical specifications of the returned product must be equivalent to the technical specifications of the purchased product.
